Simon Banks


Simon is an Associate in the Litigation & Dispute Resolution team in Manchester. He has a broad practice covering a full range of commercial and property disputes.

Simon has a particular focus on insolvency proceedings and restructuring. He commonly acts for creditors, insolvency practitioners and companies in financial difficulties, advising on contested administrations, liquidations, CVAs and bankruptcies. Simon works closely with insolvency professionals to investigate director misfeasance, trace assets and maximise returns to creditors. Simon also advises boards of directors in order to address solvency concerns pragmatically and at an early stage. Recent work relates to the CVAs of a number of household-name retailers and advising large groups of investors regarding failed property investment schemes.

Simon's wider commercial litigation work includes advising both public and private sector clients on a wide variety of corporate and commercial disputes. These often involve property assets or valuable plant and machinery. Simon has recently advised on shareholder disputes, breaches of warranties, unlawful retention of goods, and injunctive proceedings. He regularly uses alternative dispute resolution procedures where this is likely to be the most effective way to resolve the dispute quickly and pragmatically.

Simon is a member of R3 Association of Business Recovery Professionals and the Manchester Law Society Civil Litigation Committee.
