Sunil Singh


Sunil Singh is an Associate in the firm’s International Construction Disputes team and is based in our Malaysia office. 

Since his admission as an Advocate and Solicitor of the High Court of Malaya, Sunil has advised clients on a broad range of construction and engineering disputes. His experience includes matters involving descoping of works, project delays, claims relating to performance bonds, failure to meet performance guarantees, recovery of back charges and claims for loss and expense including loss of profit and interest.

Sunil’s practice focuses on alternative dispute resolution, particularly arbitration. He regularly assists clients in complex construction and infrastructure disputes and has experience in both ad hoc and institutional arbitration, as well as litigation, adjudication and expert determination proceedings.

Examples of matters on which Sunil has worked include:

  • Acting for a project company in an ad hoc arbitration concerning claims under a Power and Water Purchase Agreement relating to a major Independent Water and Power Plant in Saudi Arabia. The dispute concerns indexation and zero dispatch instructions.
  • Advising a leading EPC contractor in a dispute with its subcontractor involving partial descoping of works, valuation of completed works and recovery of back charges under a civil and cable laying subcontract.
  • Advising a leading private medical university in the Middle East in a dispute with its lead design consultant relating to a major campus expansion project.
  • Advising a major property developer on extension of time claims across multiple projects, including reviewing construction contracts and providing guidance on the application of the As Planned versus As Built delay analysis methodology.
  • Acting in an ICC arbitration seated in London representing a claimant seeking compensation for losses arising from the supply of defective photovoltaic modules in a solar project.
  • Acting in a DIAC arbitration involving claims for variations, extensions of time, relief from delay penalties and time related damages.
