Transferors and transferees should be aware of additional considerations that a case has highlighted when considering TUPE's application where the service is fragmenting.
Rebecca McKay, Laura Welchew and Vikki Cunliffe will discuss the recent fragmentation case as well as when TUPE will apply and the information and consultation obligations under the TUPE Regs. They will also give you tips for arguing that TUPE does not apply, discuss the potential liabilities for failing to inform and consult and give a round up of the pensions risks.
