Raya Al Harthy


Raya is a senior associate in the International Dispute Resolution and Litigation team currently based in Oman, having joined the firm in June 2016.

Raya is ranked as Associate to Watch by Chambers Global: Dispute Resolution, for four consecutive years where she is described as "a highly accomplished associate with a strong track record in construction and employment litigation. She is also experienced in both English and Arabic language ad hoc arbitrations, as well as appearing before the ICC. One impressed client noted: "She made the preparation of our claim very efficient.” Raya is also ranked as a "rising star" by Legal 500 and has been included on Legal 500 Private Practice Arbitration Powerlist – Middle East Region.

Raya has extensive knowledge on procedural aspects of ad hoc arbitrations, settlement of disputes involving court proceedings and mediation. Raya also has experience in ICC, LCIA and UNCITRAL arbitrations.

Raya was also an advocate before the Omani courts for 6 years. During that time, Raya gained extensive insight into local court proceedings. Raya's areas of experience include commercial litigation, tax litigation, contentious construction and employment. Raya has both English and Arabic drafting capabilities.

Relevant Experience 

  • Part of the team acting for a large Oman-based contractor in a construction arbitration administered by the ICC seated in Oman and governed by Oman law for significant extensions of time (6 year delay) and associated loss and expense against the main contractor arising from performance of MEP Works at the construction of the a major transport infrastructure project.
  • Part of the team acting for a large Oman-based contractor in a construction arbitration administered by the ICC seated in Oman and governed by Oman law for extension of time and variations in relation to the construction of a warehouse facility in Sohar Free Zone. 
  • Acting for and advising a large Oman-based contractor in an ad hoc English language construction arbitration seated in Oman and governed by Oman law relating to a flagship Oman project. Matters in dispute include: EOT claims, variations, contra charges and claims for certified amounts. 
  • Part of the team advising the EPC Contractor on an oil and gas refinery project in Oman in relation to its entitlement for extension of time and additional costs related to the COVID-19 pandemic, arising under force majeure and changes in law provisions under the EPC Contract. The EPC Contractor's current additional costs are estimated at USD 395 million. The potential arbitration would be administered by the ICC, seated in London and governed by English law.
  • Acting for and advising a large Oman-based contractor in a construction dispute in ad hoc Arabic language arbitration seated in Oman and governed by Oman law, relating to a mixed used development project. Matters in dispute include: EOT claims, variations, contra charges and claims for certified amounts.
  • Lead associate acted for a large Oman-based contractor in various ad hoc Arabic language arbitrations seated in Oman and governed by Oman law against the Omani government relating to major infrastructure projects across Oman totalling around OMR 40 million.  Matters in dispute include: EOT claims, variations, contra charges and claims for certified amounts.
  • Lead associate advising an Oman based client in relation to a commercial dispute arising out of a facilities agreement for the construction and operation of a cement handling facility in Sohar Port, advising on a potential London seated ICC arbitration. The Agreement is governed by Oman law.
  • Lead associate acting for an industry-based company in a commercial ad hoc English language arbitration seated in Oman and governed by Oman law, arising out of an oil and gas related dispute against an Oman based company in relation to the manufacturing and supply of gas pipes to a major refinery project in Oman.
