Trowers & Hamlins were delighted to team up with ecology consultants BioGains to bring you up to date with the Government's plans to introduce biodiversity net gain requirements for new development. This is set to become a big issue in the next 12 to 24 months. 

Primary legislation setting the framework for biodiversity net gain received royal assent in November 2021 and the Government is consulting on the regulations that will implement the biodiversity net gain requirements.

Planning partner Rory Stracey took a look at the key legal issues that will be central in the biodiversity net gain requirements, whilst Jon Garner of BioGains talked about how it will work in practice, and what role ecologists will need to play in discharging the net gain requirement. We were also joined by our Environmental law specialist Helen Mitcheson who looked into recent developments in the field of nitrates, phosphates and air quality in the planning system.
