Our market leading team has over 20 years' experience of advising new businesses operating in the public sector.  We have recently worked with clients on new businesses for mutuals, wholly owned local government companies, joint ventures and special purpose vehicles partly owned by the public sector. 

Our approach is that there is no 'one size fits all' solution and we provide clear, commercial advice that is tailored to the circumstances and focussed on commercial sustainability.  In particular we advise on alternative ownership vehicles and structures, funding options and tax structure to provide the optimal outcomes for new businesses, supported by pragmatic options appraisal and risk analysis.  We focus on developing delivery vehicles which best achieve the sponsors' objectives based on our experience of delivering a wide variety of solutions including companies limited by shares (or guarantee), community benefit societies, charities and trusts and limited liability partnerships.

New businesses are a means not an end so our team provides a full service to our public sector and start up clients - giving them the legal advice required to run a successful sustainable business.  Areas we usually advise on include public sector powers, procurement rules, state aid, governance, funding and employment and pensions.  We also draft and negotiate commercial contracts which underpin the new business' financial model – particularly in the early years.
