The health and social care sectors are under the twin pressures of budget constraints and a move towards co-designed services with more joint commissioning. The NHS is currently in the midst of a major transformation; the creation of Sustainability and Transformation Partnerships (STPs), Accountable Care Systems (ACSs) and Accountable Care Organisations (ACOs) is set to radically change the way services are commissioned, funded and delivered.

To genuinely deliver in this sector you will need lawyers who understand sector organisations and regulators, whether dealing with NHS or privately funded healthcare, social care, mental health, older people, working age people with physical, learning or other disabilities, those with acquired injuries, children and adult services. Our sector-based team provides a coordinated service to investors, operators, NHS bodies, local authorities and developers on funding, buying and selling, establishing, building and managing healthcare services. 

We have extensive experience of assisting sector clients adapt to this by adopting efficient contract structures for co-designed services, which are user friendly and enable efficient contract management.

We have also advised on a number of shared service care organisations including accountable provider and commissioner provider structures. Our understanding of both sectors enables us to “bridge” distinct care and health approaches to contracts and contract management.

The firm has advised on strategic outcomes arrangements for providers and commissioners since central government introduced the original “payment by results” contracts. This hybrid style of per capita payments together with a performance element does not naturally sit within the traditions of either the health or social care sectors. The firm can add value for commissioners and providers by assisting them to structure these arrangements to deliver within budget whilst ensuring a sustainable service.
