Procurement Update


The construction and property sector has continued to forge ahead this year, notwithstanding slowdown being reported in some areas. The reported case law judgments to know about have not decreased in number though.

In procurement, the National Audit Office has reported on the NDA litigation and we have seen further cases on disclosure of documents and lifting the automatic suspension whilst the Technology and Construction Court has published its Guidance Note on Procedures for Public Procurement Cases. From Europe, we have cases on selection and award criteria; excluding tenderers; a ruling about when a company wholly owned by a CA can also be a body governed by public law and  a view from the EFTA Court about when damages may be awarded for breach of  procurement law.

In the construction sector, we have seen a varied mix of cases coming through the courts. In our next update, we'll be looking at issues of concurrent delay; assessing compensation events; the application of HGCRA to completed or terminated contracts; whether a party should be given opportunity to remedy a breach before termination; and we'll look at E.On's successful appeal to the Supreme Court to enforce a fitness for purpose obligation.
