Private residential development breakfast briefing: Risks for developers under Landfill Tax Regime

In April 2018 the Landfill Tax regime was extended to all 'illegal' soil deposits. This would include made ground material relocated on site and/or natural material imported onto a site without the appropriate exemption or regulatory position statement.

The new regime is being policed by HMRC with support from the Environmental Agency and fines can be levied on any or all ‘responsible person(s)’ which would potentially include the receiver, the haulier and the producer. Richard Brinkworth from Leap will explain the details of the regime and, perhaps more importantly, how to avoid falling foul of it by using available schemes such as Materials Management Plans (MMPs) under Definition of Waste: Code of Practice (DoWCoP).

James Huckstep, a Senior Associate in the Construction team at Trowers & Hamlins, will conclude the session with a look at the contractual protections which should be considered when appointing site investigators and remediation contractors.
