Housing stock transfer guidance for local authorities published

On 12 November 2013, the Government published its long-awaited guidance for local authorities who wish to transfer all or part of their social housing stock away from the control of the council and to a private registered provider.  The guidance is intended for those councils which can complete a transfer by 31 March 2015.

"This guidance will be of particular interest to those councils which have already been working with residents on their whole-stock transfer plans," explains Rob Beiley, Housing and Regeneration partner at Trowers & Hamlins.  

Partner Tonia Secker points out that the window of opportunity – open until March 2015 – is small, "but it may beckon for councils who have been considering the merits of a smaller transfer – say, of an estate which needs investment which only transfer can deliver."

Housing and Regeneration partner Catherine Hand added, "The guidance requires councils to look at the macro benefits of stock transfer.  They have always done this in the past, but it's never before been mandatory.  The guidance could make it more challenging for local authorities because they have to demonstrate to government what other benefits stock transfer can bring."
